I frequently receive calls from the loved ones of Texas inmates seeking assistance with parole preparation. Unfortunately, many misunderstand the term “parole eligibility” and contact me too late to provide effective representation. Parole eligibility does not mean a hearing date but rather the earliest point when an inmate can be considered for release if sufficient evidence convinces the Parole Board they are no longer a threat to society.
Preparing for parole is an involved process. It requires investigating, gathering, and reviewing evidence to create a compelling parole packet, often spanning 30-40 pages. This packet must include proof of rehabilitation, plans for reintegration, and a strong argument for release, all of which ideally should be filed no later than 60 days before the voting window opens. Missing this deadline can result in the Parole Board declining to review the packet.
Parole Board rules allow inmate files to be reviewed up to 60 days before the parole eligibility date, with initial interviews typically conducted 4-6 months prior. For me to deliver the best representation, I must begin preparing a substantial parole packet well before this timeline. Ideally, we should be retained at least four-to-six months before the parole eligibility or next review date to ensure adequate time for thorough preparation.
Many attorneys use template-based forms, simply swapping out names, but such generic submissions rarely impact on the Parole Board’s decisions. Texas law places the burden of proof on the inmate to present credible evidence of rehabilitation and readiness for release. Without compelling evidence, the Parole Board must deny parole and set a new review date, which could range from one to ten years.
Contrary to common beliefs, today’s Parole Board is one of the most fair-minded groups I’ve encountered in my many years as a criminal defense attorney. Board members are open to granting parole when presented with credible evidence, detailed reentry plans, and assurances of non-recidivism. However, the challenge lies in organizing this information in a way that instills confidence in the Board. Doubts about an inmate’s ability to avoid reoffending will likely result in denial and a set-off.
